1. Introduction
These Terms and Conditions (“Terms”) govern the rights, responsibilities, and obligations of members and office bearers of the Residents Welfare Association (RWA). By becoming a member or engaging with the Association, you agree to abide by these Terms as well as the applicable laws and provisions of the Haryana Registration and Regulation of Societies Act, 2012.
2. Membership
- Membership is open only to property owners/residents of Sector 18 Part 1, Jagadhri, Yamunanagar.
- A member must be at least 21 years of age.
- In case of joint property ownership, only the first registered owner will be eligible to vote or contest elections.
- Each flat/house is entitled to one vote (“One Flat, One Vote” principle).
3. Governing Body
- The Governing Body shall consist of a minimum of three and a maximum of twenty-one office bearers.
- The term of the Governing Body shall not exceed three years.
- Elections shall be conducted as per the rules and under the supervision of the District Registrar or an appointed observer.
4. Meetings
- General Body Meetings shall be conducted with a quorum:
- First meeting – 40% of members
- Second meeting – 25% of members
- Third meeting – 15% of members
- Proxy voting is not permitted.
- Special resolutions must be passed in accordance with the Act and properly recorded.
5. Duties & Obligations of Members
- Members are required to follow community guidelines, maintain harmony, and uphold the dignity of the Association.
- Members must pay applicable fees, charges, or contributions as decided by the Governing Body.
- Members shall cooperate with the Association in all matters related to maintenance, security, and welfare activities.
6. Accounts & Compliance
- The Association shall prepare and submit annual returns including the list of members, list of office bearers, balance sheet, audit report, and annual activity report.
- All financial transactions shall be properly recorded and audited annually.
- Misuse of Association funds shall attract disciplinary and legal action.
7. Restrictions
- A Member, if not approved, shall not enroll new members, incur capital expenditure, or employ staff on behalf of the Association.
- No member shall engage in activities that harm the interests of the Association or its members.
- If a member of the RWA fails to pay the monthly contribution continuously, they will lose their right to vote in the Association’s elections at the time of voting.
8. Dispute Resolution
Any disputes arising within the Association shall be resolved internally through the Governing Body. If unresolved, the matter may be referred to the District Registrar or the competent legal authority as per the Haryana Registration and Regulation of Societies Act, 2012.
9. Amendments
These Terms & Conditions may be amended by a majority vote of the General Body in accordance with the Act and subject to approval by the District Registrar where required.
